Speedy Divorce

New Horizons Law, P.A., Michael J. Costantino, Esq. is quite often asked about the possibility of obtaining a speedy divorce.  The short answer is that in Florida it is possible for two individuals to obtain a fairly quick divorce depending on the right circumstances.

When two people in a marriage both decide that it is time to separate and divide their assets and/or set a time sharing schedule with their children, they are often beyond the tedious, emotional, and stressful aspects that go hand in hand with seeking a dissolution of marriage.  While divorce can be a complicated process that is filled with many emotions and unnecessary compromises between a husband and wife, it does not always have to be that way.

A divorce can be contested or uncontested.  In a contested divorce, the parties agree on very little so this type of a divorce can be very difficult and take a lot of time to resolve.  On the other hand, an uncontested divorce can be very simple and be completed within a couple of months provided that an attorney is involved.  But, an attorney can only represent the husband or the wife in order to avoid creating a conflict of interest.

As should be expected, the most important aspect of divorce for couples without minor children is the division of money and assets, as well as alimony.  In an uncontested divorce, these matters are generally resolved in an amicable manner.  If the parties have children, all issues related to the children are also agreed upon.

It is common that during a divorce consultation, a spouse will state to New Horizons Law, P.A., Michael J. Costantino, Esq. that he or she believes that the couple has reached an agreement.   If New Horizons Law, P.A., Michael J. Costantino, Esq. is retained to pursue an uncontested divorce, our office will put together a proposal letter to the opposing party to determine whether all issues have been resolved.  If the opposing party responds in the affirmative, then New Horizons Law, P.A., Michael J. Costantino, Esq. will draft the necessary pleadings in order move your case towards finality.

Due to the differences that may have led to separation and divorce, it is often easier for New Horizons Law, P.A., Michael J. Costantino, Esq. to communicate with your spouse in writing in order to articulate your proposed terms in order to remove the emotions that a face-to-face meeting could possibly cause.
